This was an application to have sections 43 to 46 of the Police Force and Auxiliary Services Act (PFASA) declared unconstitutional and removed from the statute book on grounds that they infringed on the rights to a fair trial and participation in public affairs of the country, freedoms of expression, association and assembly.
The court held that the matter was res judicata since it had already been decided on the merits of the case, as per section 9 of the Civil Procedure Code (CPC). The court thus found that sections 43 to 46 of PFASA have been previously declared constitutional and not in violation of human rights.
Accordingly, the application was dismissed.
